Video Session Terms

Last updated:

These Terms apply whenever a session booked through linqo takes place in virtual mode. They complement the Terms of Use and state plainly what is up to each party: for linqo, the technology; for the professional and the business, the session; for the client, the rules of those who take part.

1. When these Terms apply

A virtual session can take place in two ways, depending on the availability of the feature in the business’s account:

  • linqo video room: the call takes place inside the platform, through a link generated for that booking.
  • External link: the professional provides the link to a third-party tool, and linqo only delivers it to the client.

These Terms apply to the business, its professionals and the clients who take part in the session. They are part of the Terms of Use; on matters of virtual sessions, what is written here prevails.

2. linqo’s role

linqo provides the technical means: the booking, the link, the reminders and, when available, the video room. The session itself — what is said, advised, prescribed, taught or sold — belongs to the professional and the business.

For that reason, linqo:

  • Does not take part in the session, does not supervise it and does not monitor sessions.
  • Does not verify the identity, training, qualification or professional registration of whoever provides the session, nor the identity of whoever receives it. The board registration shown on the profile is what the professional provided.
  • Does not record, store or access the audio, video or content of sessions.
  • Does not guarantee the outcome of the session, nor that the virtual mode is suitable for the case.

The linqo video room is a general-purpose communication tool. It is not a telemedicine or telehealth platform, it is not an electronic health record, and it has no certification from any professional board or body.

3. Responsibilities of the professional and the business

Whoever provides the session is responsible for it, as they would be in an office or a studio. By offering or holding a virtual session, the professional and the business declare and undertake to:

  • Qualification: hold the training, board registration and authorizations required for the activity, keep them valid and provide truthful information on the profile.
  • Rules of the profession: know and comply with the legal and ethical rules and those of the professional board on remote sessions, including the limits of what may be done in this mode and the places where they are authorized to practice.
  • Suitability of the tool: check, before using it, whether the linqo video room or the external tool chosen meets the requirements of their profession. If it does not, not use it for that purpose.
  • Suitability of the case: assess whether a virtual session suits that client and that situation, explain the limitations of the mode and recommend an in-person session whenever necessary.
  • Consent and contract: obtain from the client, when the profession requires it, free and informed consent and the service agreement. The acceptance linqo shows before entry to the room does not replace those documents.
  • Records: keep, in their own suitable system, the health record and other records the profession requires, for the legal period. linqo is not that system.
  • Confidentiality and setting: provide the session personally, in a private place, with secure equipment and network, without unauthorized third parties present, preserving professional secrecy.
  • Identity and minors: confirm who they are talking to and, when the session is with a child, an adolescent or a person without full legal capacity, obtain the authorization of the legal guardian beforehand and follow the rules of the profession for that session.
  • Urgent situations: have a plan for situations of risk, with the client’s emergency contacts and referral to in-person services.
  • Recording: not record, photograph or broadcast the session without the client’s express prior authorization and unless the profession allows it. If they record with their own means, be solely responsible for the storage, security and use of that material.
  • Punctuality: show up on time, keep to the agreed duration and notify the client in advance when they cannot hold the session.
  • Commercial terms: define and disclose in advance the price, the payment method and the rules for cancellation, rescheduling, lateness, no-show and technical failure, and honor what was disclosed — including refunds.
  • Equipment: keep a suitable camera, microphone and connection, test them beforehand and agree with the client on an alternative channel in case the call drops.
  • Access to the room: not share the link, check who has joined before starting and end the session if there is an improper participant.
  • Personal data: process the client’s data, including health data, with an adequate legal basis, as the controller.
  • Conduct: treat the client with respect and not use the session for unlawful purposes, harassment, discrimination or offering a service the law prohibits.

The business is jointly and severally liable with the professionals it registers for compliance with this section.

4. Health care sessions

If the session is a health care service, the professional is solely responsible for complying with telehealth legislation and the rules of their board. In Brazil, Law No. 14,510/2022 requires telehealth to be carried out with the free and informed consent of the patient and under the responsibility of the health professional, guarantees the patient the right to refuse this mode and ask for in-person care, and assigns to the federal boards the ethical rules of each profession.

linqo does not provide health services, is not a party to the relationship between professional and patient, and does not replace the health record or the systems those rules require.

5. Rules for the client

If you are the client receiving the session, by entering a video room you agree to:

  • Provide truthful information and join in person. The link is personal and should not be passed on.
  • Be 18 or older, or take part with the authorization of your parent or legal guardian.
  • Be in a private place and take care of your own internet, camera and microphone.
  • Not record, photograph or disclose the session without the professional’s express authorization.
  • Treat the professional with respect. Harassment, threats, indecent exposure or any offensive conduct justify ending the session immediately.
  • Follow the business’s policy on cancellation, rescheduling, lateness, no-show and refunds.

You may end the call at any time and ask the professional for another form of service. Questions and complaints about the session should be taken to the business, which is the one providing it.

6. Urgent and emergency situations

A video session is not a channel for urgent or emergency care, and linqo does not monitor sessions. If there is a risk to life or safety, go to the nearest in-person service or call your local emergency number:

  • 911 — emergency services in the United States
  • 988 — Suicide & Crisis Lifeline in the United States, 24 hours
  • 192 (SAMU, ambulance), 193 (fire department) and 190 (police) — in Brazil
  • 188 — Centro de Valorização da Vida (CVV), emotional support in Brazil, 24 hours

Elsewhere, use the emergency number of the country you are in.

7. Recording, image and confidentiality

The linqo video room transmits audio and video in real time, encrypted in transit. linqo does not record sessions or keep a copy of what is transmitted.

No participant may record, photograph, broadcast or disclose the session without the express authorization of all the others. Whoever does so is liable under civil and criminal law for the misuse of another person’s image, voice and information.

linqo has no way of preventing a participant from recording the screen with features of their own device, and is not liable for it.

8. Technical requirements and failures

To take part you need a device with a camera and microphone, an up-to-date browser, permission to access the camera and microphone, and a stable connection. Each participant takes care of their own equipment and connection.

Call quality depends on networks and devices linqo does not control. Drops, freezes and delays may happen; when they do, what the business has defined for rescheduling and refunds applies. We recommend that the professional and the client agree on an alternative channel beforehand.

9. External link

When the professional provides the link to a third-party tool, linqo only stores that link and sends it to the client. The call takes place outside linqo, under the terms and privacy policy of that tool.

The choice belongs to the professional, who is responsible for it: for the security and availability of the tool, for whatever recording features it has, and for compliance with the rules of their profession. linqo does not check the links provided. It is prohibited to provide a link that is malicious, misleading or that leads to unlawful content.

10. Data processed in video sessions

In the linqo video room, we process the connection data needed for the call — IP address, browser and time of entry and exit — and the record of the client’s acceptance. The content of the session is not stored. The details are in the Privacy Policy.

The information exchanged during the session is processed by the professional and the business, as controllers.

11. Misuse

linqo may suspend access to the video room, or the account, of anyone who breaches these Terms, and cooperates with the authorities when the law requires it. To report misuse of a room, write to support@uselinqo.com.

12. Limits of liability

The professional and the business are fully and solely responsible for the session provided and for any harm it causes to the client or to third parties.

To the maximum extent permitted by applicable law, linqo is not liable for:

  • Acts, omissions, advice, diagnoses, prescriptions and results of the professional.
  • The professional’s lack of qualification or failure to comply with the rules of their profession.
  • No-shows, lateness, cancellations, charges or refunds between the business and the client.
  • Recording, capture or disclosure of the session by any participant.
  • Failures of connection, of devices or of external tools.
  • Use of the room in an urgent or emergency situation.

The business and the professional undertake to reimburse linqo for any claim, lawsuit or fine arising from the session, as set out in the section "Indemnification" of the Terms of Use. The limits in the section "Warranties and limits of liability" of that document also apply.

Nothing here excludes linqo’s liability for failure of the platform itself, within the limits of the Terms of Use, nor rights the law does not allow to be limited.

13. Acceptance

The business and the professional accept these Terms by accepting the Terms of Use and by offering or holding a virtual session through linqo.

The client accepts, before entering the room, the text reproduced below. We record the date, time and IP address of each acceptance.
